BURGHESIUS SRL - GUEST TERMS AND CONDITIONS
By using this website, you enter into a contractual relationship with Burghesius Srl, based in Vicolo del Cinque 59, 00153 Rome, Italy (VAT: 15493751000). Burghesius operates as a management company in its own name but on behalf of property owners (pursuant to Art. 1705 of the Italian Civil Code).
In these Booking Conditions:
“You” and “your” mean all persons named on the booking (including anyone added or substituted later).
“Holiday” or “arrangements” means your property booking.
“Arrival” means the date your arrangements commence.
1. Making Your Booking
1.1 You may book via telephone, email, online enquiry, travel agent, or via online platforms where our properties are advertised.
1.2 Bookings will be registered in our system and a confirmation email sent. You may confirm your option(s) by paying via credit/debit card or by bank transfer.
1.3 The party leader must be at least 18 years old, authorised to make the booking on behalf of all guests, and is responsible for all payments. All communications will be sent to the party leader.
1.4 Online bookings are confirmed immediately via our secure payment system. Changes or cancellations are subject to these T&Cs (Clauses 6 and 7).
1.5 Guests must read property descriptions carefully and must notify us of any specific requirements before confirming the booking.
1.6 Only registered guests may occupy the property. Invitations to external parties require prior written consent.
1.7 Identity Verification: Pursuant to Art. 109 TULPS (Italian Law), all guests must provide valid ID/Passport copies before arrival. Failure to comply results in denied access without refund.
2. Property Description and Images
2.1 Photographs and descriptions are for illustrative purposes only. While we make every reasonable effort to ensure accuracy, minor discrepancies may occur due to lighting conditions, seasonal changes, furniture updates, or ongoing improvements.
2.2 Such variations do not constitute grounds for cancellation, refund, or compensation, and no responsibility is accepted for differences that do not materially affect the stay.
3. Cost of Your Holiday
3.1 Price Breakdown: Prices are quoted in Euros. The total price displayed at checkout is the final amount due. By confirming the booking, you acknowledge that Burghesius Srl will issue a single electronic invoice representing the total cost, which is legally composed of:
a) Accommodation Fee: The portion related to the short-term lease (Exempt from VAT under Art. 10, DPR 633/72).
b) Agency, Management & Cleaning Services: The portion related to services provided by Burghesius (Subject to 22% VAT).
c) Ancillary Fees: Credit card fees (3%) or Referral fees (12%) where applicable (Subject to 22% VAT).
3.2 Tourist Tax: The Municipal Tourist Tax is not included in the rental price. It will be calculated at checkout and must be paid separately as required by local regulations.
3.3 Pricing is calculated at the time of booking confirmation and will not increase unless a genuine error is corrected. In such cases, you may cancel for a full refund or pay the corrected price.
3.4 Maximum occupancy is stated per property. Additional guests or bedrooms may incur a supplement, subject to Burghesius approval.
4. Rates and Cancellation Policy
4.1 Standard Rate: A 50% deposit is required to confirm a booking. Full payment is required if booking is within 60 days of arrival
4.2 Flexible Rate: A 0% deposit is required to confirm a booking. Full payment is required if booking is within 30 days of arrival
4.3 Accepted methods: Visa, MasterCard, American Express, Maestro, Visa Debit, MasterCard Debit, and bank transfer (bank charges apply).
4.4 Non-payment may result in cancellation, with applicable charges as set out in Clause 8.
5. Your Contract
5.1 Binding Agreement: A binding contract arises upon receipt of any payment. Burghesius Srl acts as the sole contracting party toward the Guest.
5.2 Governing Law: Italian law applies exclusively. Any dispute shall be subject to the jurisdiction of the Court of Rome.
5.3 Specific Approval: By confirming the booking, you specifically approve, pursuant to Art. 1341-1342 of the Italian Civil Code, the following clauses: Clause 8 (Cancellation charges), Clause 9 (Changes and Cancellation by Us), Clause 10 (Force Majeure), Clause 13 (Damages), Clause 15 (Early Termination), and Clause 18 (Liability).
6. Insurance
6.1 Guests are responsible for obtaining adequate travel insurance covering medical expenses, accidents, repatriation, personal possessions, cancellation charges, and liability for property damage.
6.2 Burghesius does not verify insurance policies; it is your responsibility to ensure coverage is adequate.
7. Changes by You
7.1 Notify Burghesius in writing of any requested changes. We will endeavour to assist but cannot guarantee accommodation.
7.2 For any change, we may charge €200 plus costs incurred by us or suppliers.
7.3 Increases to party size require property approval and may incur a supplement.
7.4 Date changes are treated as a cancellation and new booking; cancellation fees apply to the original booking.
8. Cancellation by You
8.1 Cancellation must be notified in writing and is effective upon acknowledgment.
8.2Cancellation charges equal the total amount due at the time of cancellation according to the selected rate (Standard or Flexible)".
8.3 Insurance may cover cancellation charges; claims are made directly to the insurer.
9. Changes and Cancellation by Us
9.1 Minor Changes
Burghesius may make minor changes to your booking or the property at any time. Minor changes are those that do not materially affect the overall quality, location, or facilities of the property.
9.2 Significant Changes
Significant changes are those that materially affect your booking, including but not limited to:
Withdrawal or unavailability of major facilities at the property (eg: terrace)
Major maintenance issues that affect the normal use of the property (e.g., prolonged loss of hot water, heating, air conditioning, or electricity)
9.3 Options for Guests in the Event of a Significant Change
If a significant change occurs, Burghesius will notify the Guest as soon as possible and offer the following options:
a) Accept the modified arrangements;
b) Book an alternative property of a similar standard, with any price difference refunded or payable as applicable;
c) Cancel the booking and receive a full refund of all monies paid for the affected property.
9.4 Force Majeure
In the event of a force majeure, as defined in Clause 10, these provisions may be overridden, and Burghesius will make reasonable efforts to assist the Guest, but cannot guarantee alternative arrangements or refunds.
10. Force Majeure
10.1 “Force majeure” includes war, riots, terrorism, industrial disputes, natural disasters, adverse weather, epidemics, airport closures, and similar events outside our reasonable control.
10.2 Burghesius is not liable for refunds, compensation, or costs arising from such events.
11. Occupancy and Safety
11.1 Only registered guests may occupy the Property.
11.2 Guests must comply with these T&Cs, Property rules, and local laws.
11.3 Guests are responsible for their own safety; minors must be supervised.
11.4 Smoking, vaping, and parties are prohibited
11.5 Guests must use safety features correctly and report maintenance issues immediately.
11.6 Guests are responsible for assessing the suitability of the Property for themselves and all Guest Members, including but not limited to checking for accessibility, mobility constraints, stairs, elevators, and other features. Burghesius will provide information to the best of its ability, but Guests must verify any details critical to their needs before confirming a booking.
11.7 Pets are prohibited unless expressly agreed, including emotional support or service animals in accordance with local laws.
12. Confidentiality
12.1 Any professional or commercial photography, filming, or content creation activity (including but not limited to photoshoots, video productions, social media campaigns, and influencer content) is strictly prohibited without prior written consent from Burghesius. Unauthorized use may result in immediate termination of the booking pursuant to Clause 15, without refund and the Guest may be held liable for any resulting damages, including loss of reputation, loss of revenue, or legal costs incurred by Burghesius or the property owner.
12.2 Guests may not disclose property addresses or owner identities.
13. Damages
13.1 Guests are responsible for all damage caused by themselves, Guest Members, or third parties.
13.2 All damages must be reported immediately. Burghesius or the owner may retain security deposits or charge for excess costs.
13.3 If no security deposit is requested, guests may be required to subscribe to a damage waiver programme.
14. Maintenance and Resolution
14.1 Guests must notify Burghesius promptly of any maintenance issues.
14.2 Major issues (hot water, heating, AC, electricity) will be addressed within 24–48 hours.
14.3 If unresolved, an alternative property may be offered; if unavailable, a refund for remaining nights will be provided.
14.4 Guests acknowledge that all properties are prepared to a high standard prior to arrival. Minor cleanliness or housekeeping issues, including issues that are promptly addressed by the Burghesius team, do not constitute grounds for a refund or compensation. Only major, unresolved issues affecting the normal use of the property (such as hot water, heating, air conditioning, or electricity) may entitle the Guest to a refund in accordance with clause 14.3.
15. Early Termination of Booking
15.1 Burghesius may terminate a booking without refund if:
a) Fails to make any required payments when due;
b) Breaches these Terms and Conditions, the Property rules, or any applicable law or regulation;
c) Uses the Property for unlawful, immoral, or unauthorized activities;
d) Causes a nuisance, disturbance, or damage to the Property, neighbours, or surrounding community;
e) Engages in aggressive, abusive, threatening, harassing, or inappropriate behaviour toward Burghesius staff, the property owner, neighbours, or service providers, including repeated or unreasonable demands for refunds;
f) Commits any act or omission that poses a risk to health or safety;
g) Provides false or misleading information during the booking or verification process;
h) Engages in conduct that may reasonably harm the reputation, goodwill, or standing of Burghesius or the Property owner.
15.2 Reasonable notice will be given where possible, except in cases of immediate health, safety, or property risks.
16. Concierge and Ancillary Services
16.1 Optional services may have separate terms.
16.2 Cancellation and refunds for these services are subject to specific acceptance at the time of booking.
17. Arrival and Departure
17.1 Guests must strictly comply with the stated arrival and departure times. Standard Check-in is from 15:00 (3:00 PM) and Standard Check-out is no later than 10:00 AM, unless otherwise agreed in writing.
17.2 Late Check-out Penalty: Failure to vacate the property by the specified check-out time (without prior written authorization) will result in an automatic "Late Check-out Fee".
17.3 If the delay exceeds 3 hours, Burghesius reserves the right to charge an additional full night's rate at the current daily price. This charge is a penalty for the operational disruption caused to cleaning schedules and subsequent guest arrivals and does not entitle the Guest to further occupancy of the property.
17.4 Early or late arrivals are subject to availability and may incur additional service charges as communicated by our team.
18. Liability
18.1 Burghesius exercises reasonable care in selecting properties and suppliers.
18.2 Burghesius is not responsible for:
Acts of third parties
Indirect or consequential losses
Injury, loss, or damage not caused by our negligence
18.3 Maximum liability for non-personal injury claims is twice the booking price.
19. Amendments
19.1 Burghesius may amend these T&Cs at any time and will communicate changes electronically.
20. Governing Law
20.1 Italian law applies exclusively.
20.2 All disputes are subject to the jurisdiction of the Italian courts.
